1. About us and this agreement
In Love Weddings is operated by Bjorn Schmal, ABN 81 605 336 290, based on Tamborine Mountain, Queensland 4272. You can contact us at contact@inlove.pictures or 0477 932 987.
“We”, “us” and “our” mean In Love Weddings. “You” means the client or clients named in the booking agreement.
Your agreement consists of these terms and the written booking summary we provide, including your selected package, event date, locations, coverage, deliverables, price and any specifically agreed changes. A change agreed by both parties in writing takes priority over an inconsistent general term. Nothing in the agreement overrides rights that cannot lawfully be excluded.
We provide the applicable terms before you accept the booking. Later website updates do not change an existing booking unless we both agree in writing.
2. Your booking
An enquiry or availability check does not confirm a booking. After reviewing your booking request, we will send a booking summary, these terms and an invoice.
Unless we specify otherwise in writing, we will provisionally hold your date for 14 days from that offer. Your booking is secured when you accept the agreement and pay the $500 booking payment within that period. The booking payment forms part of the total package price; it is not an additional charge.
If we have not received acceptance and payment by the end of the hold period, the offer and provisional hold expire. Please contact us to check availability before accepting or paying after that date.
We will normally arrange a final planning discussion one to two weeks before the wedding.
3. Prices, payment and additional services
Prices are in Australian dollars. The total price, including any applicable GST and agreed mandatory charges, will be shown in your booking summary or invoice before you accept.
The remaining balance is due on your wedding day, unless we agree to a different payment schedule in writing. Payments may be made by bank transfer or another agreed method. Any payment plan must be agreed in writing.
Extra coverage is subject to availability and your approval. Unless a different rate is agreed in writing, additional coverage costs $350 per hour for each photographer or videographer whose coverage is extended. We will confirm the additional charge and how any part-hour is billed before you approve it. We will not add unapproved coverage or optional services to your bill.
Changes to your package, locations or deliverables must be agreed in writing, together with any change in price. We will not increase the agreed package price simply because our advertised prices later change.
4. If you cancel before the event
Please notify us in writing as soon as you decide to cancel. The following policy applies to a cancellation for personal reasons or a change of plans. It does not replace your rights where we fail to provide the agreed services, breach the agreement or fail to meet a consumer guarantee.
If you cancel before the event, any cancellation charge will be limited to our reasonable, substantiated net loss caused by the cancellation, capped at $500, regardless of how close to the event you cancel. The booking payment counts towards this cap and is not an additional charge. We will refund the rest of the payments you have made.
In assessing net loss, we will account for work already undertaken, unavoidable commitments and any properly substantiated lost booking income. We will deduct costs we avoid and replacement-booking income attributable to the released capacity. We will take reasonable steps to reduce our loss and will not recover the same amount twice.
We will provide an itemised explanation and supporting information for any cancellation charge. There is no automatic entitlement to retain the whole booking payment or charge the whole package price. If your payments exceed the applicable charge, we will refund the difference. If a properly supported charge exceeds the payments made, we may invoice the difference, subject to your rights under law.
Where a refund is due, we will arrange it promptly. A service credit may be offered as an alternative only if you agree to it; we will not substitute a credit for a refund to which you are entitled.
5. Postponements and changes
Tell us promptly if you need to change your date or locations. If your new date is available, we will transfer payments already made without a separate date-change fee. Any changes in scope or unavoidable additional costs must be disclosed and agreed before you accept the revised booking.
If we cannot cover your new date with the agreed team, we may offer a suitably experienced replacement. You may review that proposal before deciding whether to accept it. We do not guarantee that a replacement will always be available.
If no new date or replacement arrangement is agreed, we will treat the booking as a cancellation notified on the date you requested the postponement, subject to section 4 and applicable law. We will not treat a declined materially different service as an automatic breach by you.
If a law, venue closure or other exceptional event prevents the wedding or the agreed services from proceeding, we will discuss the available options promptly. Any refund, payment or termination rights will be determined under the agreement and applicable law, rather than by an automatic forfeiture of payments.
6. Coverage and planning
Your booking summary identifies whether you have booked photography, videography or both; the number of team members; the coverage hours; and the photographs, films and other deliverables included.
Unless agreed otherwise, coverage is consecutive on the event date. Travel between locations during that period forms part of the coverage time. We will agree on start and finish times during planning.
Please provide an accurate schedule, location details, key contacts and any important cultural, access or personal requirements. Tell us about essential people, moments and requested shots before the wedding so we can assess and plan for them.
We use professional judgement to capture the significant parts of your day. A live event cannot be repeated in every detail, so we cannot promise every expression, guest or requested image. However, we remain responsible for the agreed coverage and for providing our services with due care and skill. A shot does not become unimportant simply because it was not listed in advance.
If the day runs late, we will discuss the effect on coverage and any available extension. Delays do not automatically authorise extra charges.
7. Venue access, permissions and working conditions
You are responsible for arranging access to the event locations you book and telling the venue and celebrant that photography or videography is planned. Please inform us of any known restrictions.
We are responsible for permissions, qualifications and legal compliance that apply to us as the service provider. Any special location permit or cost to be arranged by you must be identified and agreed before the relevant activity. You do not warrant that you own the rights to everything that happens to appear at the wedding.
We will respect reasonable venue and ceremony rules and explain known restrictions that may materially affect the result. Guest movement, available light, sound systems and the timing of events may affect what can be captured. We will take reasonable steps to manage these conditions and use suitable equipment and techniques.
For clear ceremony and speech audio, we may request microphone access, a lapel microphone or access to the venue sound system. If an option is declined or unavailable, we will explain the likely effect and discuss reasonable alternatives. This is not a blanket exclusion of our responsibility for sound recording.
Our team must be able to work safely. If there is a serious safety risk, harassment or unlawful conduct, we may pause affected work and, where practicable, give you or your nominated contact an opportunity to address it. We will resume when safe and will only end coverage where reasonably necessary. Any financial adjustment will reflect the circumstances, work provided and applicable law.
8. Meals and breaks
For coverage of six hours or more, please arrange a meal for each photographer and videographer attending, and access to drinking water. Tell us in advance if a meal cannot be provided so we can agree on a practical arrangement.
We will coordinate reasonable breaks around the schedule and avoid agreed key moments where practicable. We will not leave the venue for an extended meal break without discussing it with you or your nominated contact, except where an immediate health or safety need requires it. Break arrangements do not remove our obligation to provide the agreed service.
9. Drone coverage
Drone operation depends on safety, weather, airspace rules, venue permissions and the operator’s legal requirements. The operator decides whether a flight can safely and lawfully proceed. We cannot promise a particular flight or aerial shot.
If a separately priced drone add-on cannot be provided at all, we will refund that add-on. If part of it is provided, we will discuss a proportionate adjustment where appropriate.
Where drone coverage is bundled into a package or promotion, we will describe any conditions before booking. If an agreed inclusion cannot be supplied, we will discuss an appropriate remedy or alternative, subject to your consumer rights. Calling an inclusion promotional does not remove those rights.
10. Editing and creative approach
Please review our portfolio before booking and discuss any essential style requirements with us. We will use professional judgement in selecting and editing images and footage, consistently with the service, style and any specific requirements agreed for your booking.
Standard photographic editing includes exposure, colour, contrast, cropping and tonal adjustments. Substantial retouching, object removal, body alteration or other specialist edits are included only where agreed in writing. We will quote any optional additional editing before doing chargeable work.
Natural differences in venue, lighting, weather and the events of the day mean your work will not be identical to another couple’s. Creative discretion does not excuse a failure to provide the agreed service or meet consumer guarantees.
11. Film drafts and revisions
Unless your booking summary specifies otherwise, the film-editing process includes a first draft and a second draft for review. Please provide one consolidated list of requested changes after each draft.
Further optional changes are charged at $150 per hour only after we explain the scope, estimate and obtain your approval. Corrections needed because of our editing error, or to bring the work into line with the agreed service or your statutory rights, will not attract a revision charge.
Changes outside the agreed package, including a substantially different film structure or additional deliverables, will be quoted separately. We will not treat silence or a missed review date as a waiver of your consumer rights.
12. Music and material you supply
We use music we are entitled to include under the applicable licence. Let us know about preferred songs early; we will confirm whether the necessary rights are available. Buying a song or subscribing to a music service does not by itself authorise its use in a wedding film.
For photographs, recordings or other material you give us to include, you must have permission for the intended use or tell us if you are unsure. We will discuss unsuitable or unlicensed material rather than assume it can be used.
Music and third-party content may have conditions on public sharing or commercial use. We will tell you about relevant restrictions on the deliverables we supply. A social platform’s copyright claim does not by itself determine whether the work was licensed; contact us so we can help investigate.
13. Delivery and file specifications
Your booking summary will state the deliverables and delivery timeframe. Our usual aim is to deliver final work within 30 days of the wedding, with up to 90 days during peak periods; the timeframe applying to your booking will be confirmed before you accept it. Any agreed express service or separate photo and film deadline will be recorded there.
If a delay becomes likely, we will explain it promptly and provide an updated estimate. We cannot extend an agreed deadline indefinitely or remove your remedies by describing all timeframes as a guide. If no timeframe has been agreed, delivery must occur within a reasonable time.
Unless your package states a higher specification:
- edited photographs are supplied as high-resolution JPEGs, at least 3,000 pixels on the long edge;
- edited films are supplied as digital video files at a minimum resolution of 1920 × 1080 pixels for standard landscape delivery.
Any specifically agreed 4K film, portrait-format social edit, image quantity, film duration, ceremony recording or speech recording will be identified in the booking summary. A higher specification expressly promised in your accepted package is not reduced by these minimums.
RAW photographs, unedited video, project files and working files are not included unless expressly agreed. If you purchase unedited material, we will explain the format and scope; it may contain duplicate takes, incomplete clips or material requiring specialist software and does not replace the edited deliverables.
Please download delivered files promptly and keep your own backups. We do not promise permanent online hosting or indefinite archiving. Any specific gallery expiry or retention period applying to your booking will be disclosed before acceptance. This does not remove our responsibility to take reasonable care of material needed to complete the booking or meet our legal obligations.
14. Copyright and your use of the work
You and we expressly agree that, as between you and us and subject to third-party rights, copyright in the original photographs, footage and films created by us for your booking will belong to Bjorn Schmal trading as In Love Weddings. This agreement is intended to modify any default commissioned-work ownership rules that would otherwise give you ownership. We will arrange the rights needed from team members and contractors to provide the agreed work and the licence below. You retain rights in material you supply.
On payment of the agreed price, we grant you a perpetual, worldwide, non-exclusive, royalty-free licence to download, store, print and share the final deliverables for personal, non-commercial purposes, including personal social-media posts, subject to any third-party restrictions disclosed before booking. You may use a printing service to make personal prints and albums. Any temporary permission to use previews will be confirmed when they are supplied.
Copyright ownership does not give us unrestricted permission to publish images of you; promotional use is governed by section 15.
Please ask us before supplying work to a business for its advertising, selling or commercially licensing it. We will consider reasonable requests. Nothing in this section limits uses permitted by law or your consumer rights.
15. Promotional use and opting out
By accepting this agreement, you give us permission to use selected photographs and film excerpts featuring you to promote In Love Weddings through our portfolio, website, social media, advertising and sample work. We will bring this permission and your opt-out clearly to your attention during booking.
You may opt out when booking or later by emailing contact@inlove.pictures. Opting out does not change your package price or service. Please tell us before the wedding if you want the whole booking kept private so we can record that preference for the team.
If you opt out after publication, we will stop new promotional use and remove the relevant content from channels we control within a reasonable time. We cannot recall printed material already distributed or guarantee removal of copies independently shared by others, but we will take reasonable steps concerning promotional placements we authorised and control.
Your permission applies to your own image and does not establish that you can consent for every guest. We will consider separate permission requirements, particularly for prominently featured guests and children, and will not rely on attendance alone as blanket promotional consent. We will seek separate approval for unrelated third-party advertising or sale of images as stock content.
Please tell guests that photography and filming are taking place, and let us know about privacy requests or people who should not be featured. We will take reasonable steps to accommodate them and remain responsible for applicable privacy and consent obligations.
16. Team members, illness and replacement services
Your booking summary will identify any team member whose personal attendance is specifically promised. Otherwise, the booking is for the In Love Weddings team and the agreed level of service.
If illness, accident or another genuine problem affects the planned team, we will tell you as soon as reasonably possible and make reasonable efforts to arrange a suitably experienced replacement. We will discuss any material change with you. We remain responsible for services we subcontract; appointing a replacement does not automatically end our obligations.
If we cannot provide the agreed service or a suitable replacement acceptable to you, we will refund payments for the service not provided. Where no service can be provided and the whole booking is cancelled by us, we will refund all payments for it, including the booking payment. These refunds do not exclude any further remedy available under law.
17. Problems, loss of material and consumer rights
We will provide our services with due care and skill, take reasonable precautions to protect captured material and use reasonable contingency measures appropriate to the booking. If a problem, equipment failure or loss of material affects the service or deliverables, we will tell you promptly and work with you on an appropriate remedy.
Nothing in these terms excludes, restricts or modifies a consumer guarantee, remedy or other right that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation. Depending on the circumstances, remedies may include correction, resupply, a reduction in price, cancellation, a refund or compensation for reasonably foreseeable loss. A refund is not automatically the limit of our responsibility.
References to live-event limitations, third-party restrictions or events beyond reasonable control do not excuse a failure to take reasonable care or remove rights that the law gives you.
18. Travel and accommodation
Your written quote will identify the included travel area and any additional travel, parking, accommodation or airfare charges before you accept the booking. We will not add an unquoted mandatory travel charge afterward without your agreement.
If you request a change of locations that increases travel requirements, we will explain any additional cost and obtain your approval before confirming that change. Flight and accommodation arrangements will be agreed in advance.
19. Contact and resolving concerns
Please contact contact@inlove.pictures or 0477 932 987 if you have a question, need to request a change or believe there is a problem with our services. Include your name, event date and the details so we can respond constructively and promptly.
We encourage direct discussion, but this does not prevent you from contacting Queensland’s Office of Fair Trading, seeking independent advice or using a court or tribunal with jurisdiction.
Queensland law and applicable Commonwealth law govern this agreement, without limiting any mandatory protections or rights to bring proceedings that apply to you.
